Dear Mr. Sutton:


I am in receipt of a letter dated JUL 25 2005 and written in your name.  I thought that you would like to know that it contains significant misstatements of fact.  It is marked at the top right with the following code: CC:SB:6:GL-138884-05 and BMWilpon.  I am quite sure that a copy exists in your office.


That letter begins with the charge: “The Area Manager of the Internal Revenue Service (IRS) has notified this office that you have not fully complied with the provisions of the summonses served upon you ….”  It goes on to state “… those summons required you to appear before Revenue Officer V. Dietz on July 25, 2005, and testify and/or produce books, records or other documents….”  Mr. Sutton, that letter, sent in you name, was postmarked July 25, 2005!  Your minions don’t waste much time, do they?  It leads one to believe that these letters are carelessly prepared ahead of time, and pumped out in haste.


In the first place, Mr. Sutton, one summons requested that I appear on July 22, 2005 and the second summons requested that I appear on July 25, 2005.  Mr. Dietz granted my request to combine both meetings into one on July 22, 2005.  I appeared at the appointed time on July 22, 2005, and I testified as requested in the summonses. 


If the Area Manager notified your office that I had not “fully complied with the provisions of the summonses”, then the “Area Manager” has lied to you.  In addition to Mr. Dietz and me, there was also in attendance another IRS employee and my live witness, who can testify by affidavit as to the events of July 22, 2005.  Moreover, Mr. Dietz and I are each in possession of an audio tape that will corroborate the events as well.


I have fully complied with the provisions of the summons, Mr. Sutton, but Mr. Dietz has not complied with any of the requirements of the law on which the summons was based.  I completely disagree with the charges stated in the letter sent to me in your name, and demand that it be rescinded in writing by return mail.
