Avery responds to Defendants’ Special Exceptions

  1. The Texas Legislature cannot pass an Act granting itself Sovereignty over the People of Texas.
  2. The Texas Legislature cannot pass an Act granting themselves Sovereign Immunity from invasion of the private property rights.
  3. Therefore, the Texas Tort Claims Act (TTCA) and the resultant Texas Civil Practice & Remedy Code (CPRC) is unlawful and void as if never passed.
  4. The remedial law (TTCA & CPRC) that says GBRA and its officers are immune from acts done in their discretion is void.
  5. The remedial law (TTCA & CPRC) that says GBRA and its employees have waived immunity only for their acts of operating a motor vehicle is void.
  6. The remedial law (TTCA & CPRC) that says GBRA is immune from the intentional torts or wrong doings such as Slander done by their officers and employees is void.
  7. The remedial law (TTCA & CPRC) that says GBRA is immune from the intentional torts or wrong doings such as its officers using a criminal prosecution to achieve a civil ends like stopping an RV Park from developing is void.
  8. The remedial law (TTCA & CPRC) that says GBRA is immune from the intentional acts of telling Homeland Security only part of the story about Plaintiff and filing an incomplete complaint with the county prosecutor is void.
